TSI has been working with the Office of Fair Trading in its efforts to ensure car dealers are aware of the law by producing guidance for second-hand car dealers on compliance with Consumer Protection from Unfair Trading Regulations 2008 and the Sale of Goods Act 1979 (as amended).

It is important research into the second-hand car market that the OFT has carried out and we support the production of guidance for dealers and consumers so that a better understanding of the law and of consumers' rights can be gained.

Trading standards will be guided by the OFT on when they should be enforcing consumer protection legislation and at the same time, TSI would like to see consumers signposted to Codes of Practice. Perhaps it is an appropriate time for the Society of Motor Manufacturers and Traders to think about producing a Code of Practice for second-hand cars that will enable consumers to make better decisions when choosing a trader and making a purchase.
