TSI response (PDF 119KB). TSI recognises and supports the need for some parts of the proposed legislation to give the ability to recall and withdraw to some UK enforcement authorities who currently do not have such powers. It does not, however, support proposals to also introduce new legislation concerning the misuse of the CE mark - this is best dealt with using existing legislation.

Charles Milne of the Food Standards Agency Scotland has offered a stout repost to MEPs' rejection of the colour coding system. TSI is concerned that authorised officers do not appear to have the power to seize documents and records which they have reason to believe may be required as evidence in proceedings under these Regulations. TSI is also concerned that the manner in which abbreviations are used in the Regulations could cause confusion.
