Takeaway owner fined £35,000 for serious food offences

The court heard that the case was very serious, and Miah would have been jailed if he hadn’t listened to the authorities and reacted properly to concerns.

Not only was there evidence of cross contamination and poor hygiene, Miah’s business had also failed to heed allergen advice. Two test purchases of curry were made from the takeaway. On both occasions, the court heard, the food was ordered ‘without peanuts’ and on both occasions, peanuts were present.

Magistrates heard that Miah had complied with environmental and trading standards’ officers who carried out the investigation.  Miah, director of Eastern Style Tandoori Ltd, admitted all the charges.

Speaking after the court case, Wirral’s Cabinet Member for the Environment, Cllr Bernie Mooney, said that Miah’s negligence could have had disastrous consequences:  ‘We will not fail to pursue and prosecute businesses that don’t take their responsibilities seriously. Aside from the hygiene issues, which were bad enough, failing to take notice of allergies is potentially fatal.’
